Sklep Internetowy www.turowskikrzysztof.com dba o prawa konsumenta. Konsument nie może zrzec się praw przyznanych mu w Ustawie o Prawach Konsumenta. Postanowienia umów mniej korzystne dla konsumenta niż postanowienia Ustawy o Prawach Konsumenta są nieważne, a w ich miejsce stosuje się przepisy Ustawy o Prawach Konsumenta. Dlatego też postanowienia niniejszego Regulaminu nie mają na celu wyłączać ani ograniczać jakichkolwiek praw konsumentów przysługujących im na mocy bezwzględnie wiążących przepisów prawa, a wszelkie ewentualne wątpliwości należy tłumaczyć na korzyść konsumenta. W przypadku ewentualnej niezgodności postanowień niniejszego Regulaminu z powyższymi przepisami, pierwszeństwo mają te przepisy i należy je stosować.

1. POSTANOWIENIA OGÓLNE
1.1. Sklep Internetowy dostępny pod adresem internetowym www.turowskikrzysztof.com prowadzony jest przez Krzysztofa Turowskiego prowadzącego działalność gospodarczą pod firmą Krzysztof Turowski, wpisaną do Centralnej Ewidencji i Informacji o Działalności Gospodarczej Rzeczypospolitej Polskiej prowadzonej przez ministra właściwego do spraw gospodarki, posiadającą: adres miejsca wykonywania działalności Nowa Piasecznica 8/8, 96-516 Szymanów, NIP 4970010366, REGON: 367088625,  adres poczty elektronicznej: contact@turowskikrzysztof.com
1.2. Niniejszy Regulamin skierowany jest zarówno do konsumentów, jak i do przedsiębiorców korzystających ze Sklepu Internetowego (z wyjątkiem pkt. 11 Regulaminu, który skierowany jest wyłącznie do przedsiębiorców).
1.3. Administratorem danych osobowych przetwarzanych w związku z realizacją postanowień niniejszego Regulaminu jest Usługodawca. Dane osobowe przetwarzane są w celach, w zakresie i w oparciu o zasady wskazane w Regulaminie Sklepu Internetowego. Podanie danych osobowych jest dobrowolne. Każda osoba, której dane osobowe przetwarza Usługodawca ma prawo do wglądu w ich treść oraz prawo do ich aktualizacji i poprawiania.
1.4. Definicje:
1.4.1. DZIEŃ ROBOCZY – jeden dzień od poniedziałku do piątku z wyłączeniem dni ustawowo wolnych od pracy.
1.4.2. FORMULARZ REJESTRACJI – formularz dostępny w Sklepie Internetowym umożliwiający utworzenie Konta.
1.4.3. FORMULARZ ZAMÓWIENIA – Usługa Elektroniczna, interaktywny formularz dostępny w Sklepie Internetowym umożliwiający złożenie Zamówienia, w szczególności poprzez dodanie Produktów do elektronicznego koszyka oraz określenie warunków Umowy Sprzedaży, w tym sposobu dostawy i płatności.
1.4.4. KLIENT – (1) osoba fizyczna posiadająca pełną zdolność do czynności prawnych, a w wypadkach przewidzianych przez przepisy powszechnie obowiązujące także osoba fizyczna posiadająca ograniczoną zdolność do czynności prawnych; (2) osoba prawna; albo (3) jednostka organizacyjna nieposiadająca osobowości prawnej, której ustawa przyznaje zdolność prawną; – która zawarła lub zamierza zawrzeć Umowę Sprzedaży ze Sprzedawcą.
1.4.5. KODEKS CYWILNY – ustawa kodeks cywilny z dnia 23 kwietnia 1964 r. (Dz.U. 1964 nr 16, poz. 93 ze zm.).
1.4.6. KONTO – Usługa Elektroniczna, oznaczony indywidualną nazwą (loginem) i hasłem podanym przez Usługobiorcę zbiór zasobów w systemie teleinformatycznym Usługodawcy, w którym gromadzone są dane podane przez Usługobiorcę oraz informacje o złożonych przez niego Zamówieniach w Sklepie Internetowym.
1.4.7. NEWSLETTER – Usługa Elektroniczna, elektroniczna usługa dystrybucyjna świadczona przez Usługodawcę za pośrednictwem poczty elektronicznej e-mail, która umożliwia wszystkim korzystającym z niej Usługobiorcom automatyczne otrzymywanie od Usługodawcy cyklicznych treści kolejnych edycji newslettera zawierającego informacje o Produktach, nowościach i promocjach w Sklepie Internetowym.
1.4.8. PRODUKT – dostępna w Sklepie Internetowym rzecz ruchoma będąca przedmiotem Umowy Sprzedaży między Klientem a Sprzedawcą.
1.4.9. REGULAMIN – niniejszy regulamin Sklepu Internetowego.
1.4.10. SKLEP INTERNETOWY – sklep internetowy Usługodawcy dostępny pod adresem internetowym www.turowskikrzysztof.com na platformie WordPress.
1.5. SPRZEDAWCA; USŁUGODAWCA – Krzysztof Turowski prowadzący działalność gospodarczą pod firmą Krzysztof Turowski, wpisaną do Centralnej Ewidencji i Informacji o Działalności Gospodarczej Rzeczypospolitej Polskiej prowadzonej przez ministra właściwego do spraw gospodarki, posiadająca: adres miejsca wykonywania działalności Nowa Piasecznica 8/8, 96-516 Szymanów, NIP 4970010366, adres poczty elektronicznej: contact@turowskikrzysztof.com
1.5.1. UMOWA SPRZEDAŻY – umowa sprzedaży Produktu zawierana albo zawarta między Klientem a Sprzedawcą za pośrednictwem Sklepu Internetowego.
1.5.2. USŁUGA ELEKTRONICZNA usługa świadczona drogą elektroniczną przez Usługodawcę na rzecz Usługobiorcy za pośrednictwem Sklepu Internetowego.
1.5.3. USŁUGOBIORCA – (1) osoba fizyczna posiadająca pełną zdolność do czynności prawnych, a w wypadkach przewidzianych przez przepisy powszechnie obowiązujące także osoba fizyczna posiadająca ograniczoną zdolność do czynności prawnych; (2) osoba prawna; albo (3) jednostka organizacyjna nieposiadająca osobowości prawnej, której ustawa przyznaje zdolność prawną; – korzystająca lub zamierzająca korzystać z Usługi Elektronicznej.
1.5.4. USTAWA O PRAWACH KONSUMENTA, USTAWA – ustawa z dnia 30 maja 2014 r. o prawach konsumenta (Dziennik Ustaw z roku 2014 poz. 827 z późniejszymi zmianami).
1.5.5. ZAMÓWIENIE – oświadczenie woli Klienta składane za pomocą Formularza Zamówienia i zmierzające bezpośrednio do zawarcia Umowy Sprzedaży Produktu ze Sprzedawcą.

2. USŁUGI ELEKTRONICZNE W SKLEPIE INTERNETOWYM
2.1. W Sklepie Internetowym dostępne są następujące Usługi Elektroniczne: Konto, Formularz Zamówienia oraz Newsletter.
2.1.1. Konto – korzystanie z Konta możliwe jest po wykonaniu łącznie trzech kolejnych kroków przez Usługobiorcę – (1) wypełnieniu Formularza Rejestracji, (2) kliknięciu pola „Załóż konto-” oraz (3) potwierdzeniu chęci utworzenia Konta poprzez kliknięcie w link potwierdzający przesłany automatycznie na podany adres poczty elektronicznej. W Formularzu Rejestracji niezbędne jest podanie przez Usługobiorcę następujących danych Usługobiorcy: imię i nazwisko/nazwa firmy, adres (ulica, numer domu/mieszkania, kod pocztowy, miejscowość, kraj), adres poczty elektronicznej, numer telefonu kontaktowego oraz hasło. W wypadku Usługobiorców niebędących konsumentami niezbędne jest także podanie nazwy firmy oraz numeru NIP.
2.1.1.1. Usługa Elektroniczna Konto świadczona jest nieodpłatnie przez czas nieoznaczony. Usługobiorca ma możliwość, w każdej chwili i bez podania przyczyny, usunięcia Konta (rezygnacji z Konta) poprzez wysłanie stosownego żądania do Usługodawcy, w szczególności za pośrednictwem poczty elektronicznej na adres: contact@turowskikrzysztof.com lub też pisemnie na adres: Nowa Piasecznica 8/8, 96-516 Szymanów
2.1.2. Formularz Zamówienia korzystanie z Formularza Zamówienia rozpoczyna się z momentem dodania przez Klienta pierwszego Produktu do elektronicznego koszyka w Sklepie Internetowym. Złożenie Zamówienia następuje po wykonaniu przez Klienta łącznie dwóch kolejnych kroków (1) po wypełnieniu Formularza Zamówienia i (2) kliknięciu na stronie Sklepu Internetowego po wypełnieniu Formularza Zamówienia pola Zamówienie z obowiązkiem zapłaty- – do tego momentu istnieje możliwość samodzielnej modyfikacji wprowadzanych danych (w tym celu należy kierować się wyświetlanymi komunikatami oraz informacjami dostępnymi na stronie Sklepu Internetowego). W Formularzu Zamówienia niezbędne jest podanie przez Klienta następujących danych dotyczących Klienta: imię i nazwisko/nazwa firmy, adres (ulica, numer domu/mieszkania, kod pocztowy, miejscowość, kraj), adres poczty elektronicznej, numer telefonu kontaktowego oraz danych dotyczących Umowy Sprzedaży: Produkt/y, ilość Produktu/ów, miejsce i sposób dostawy Produktu/ów, sposób płatności. W wypadku Klientów niebędących konsumentami niezbędne jest także podanie nazwy firmy oraz numeru NIP.
2.1.2.1. Usługa Elektroniczna Formularz Zamówienia świadczona jest nieodpłatnie oraz ma charakter jednorazowy i ulega zakończeniu z chwilą złożenia Zamówienia za jego pośrednictwem albo z chwilą wcześniejszego zaprzestania składania Zamówienia za jego pośrednictwem przez Usługobiorcę.
2.1.3. Newsletter – korzystanie z Newslettera następuje po podaniu w zakładce -Newsletter- widocznej na stronie Sklepu Internetowego adresu poczty elektronicznej, na który mają być przesyłane kolejne edycje Newslettera i kliknięciu pola -Zapisz się-. Na Newsletter można się również zapisać poprzez zaznaczenie odpowiedniego checkboxa w trakcie zakładania Konta – z chwilą utworzenia Konta Usługobiorca zostaje zapisany na Newsletter.
2.1.3.1. Usługa Elektroniczna Newsletter świadczona jest nieodpłatnie przez czas nieoznaczony. Usługobiorca ma możliwość, w każdej chwili i bez podania przyczyny, wypisania się z Newslettera (rezygnacji z Newslettera) poprzez wysłanie stosownego żądania do Usługodawcy, w szczególności za pośrednictwem poczty elektronicznej na adres: contact@turowskikrzysztof.com lub też pisemnie na adres: Nowa Piasecznica 8/8, 96-516 Szymanów
2.2. Wymagania techniczne niezbędne do współpracy z systemem teleinformatycznym, którym posługuje się Usługodawca: (1) komputer, laptop lub inne urządzenie multimedialne z dostępem do Internetu; (2) dostęp do poczty elektronicznej; (3) przeglądarka internetowa: Mozilla Firefox w wersji 11.0 i wyższej lub Internet Explorer w wersji 7.0 i wyższej, Opera w wersji 7.0 i wyższej, Google Chrome w wersji 12.0.0 i wyższej; (4) zalecana minimalna rozdzielczość ekranu: 1024×768; (5) włączenie w przeglądarce internetowej możliwości zapisu plików Cookies oraz obsługi Javascript.
2.3. Usługobiorca obowiązany jest do korzystania ze Sklepu Internetowego w sposób zgodny z prawem i dobrymi obyczajami mając na uwadze poszanowanie dóbr osobistych oraz praw autorskich i własności intelektualnej Usługodawcy oraz osób trzecich. Usługobiorca obowiązany jest do wprowadzania danych zgodnych ze stanem faktycznym. Usługobiorcę obowiązuje zakaz dostarczania treści o charakterze bezprawnym.
2.4. Tryb postępowania reklamacyjnego:
2.4.1. Reklamacje związane ze świadczeniem Usług Elektronicznych przez Usługodawcę oraz pozostałe reklamacje związanie z działaniem Sklepu Internetowego (z wyłączeniem procedury reklamacji Produktu, która została wskazana w pkt. 6 i 7 Regulaminu) Usługobiorca może składać na przykład:
2.4.2. pisemnie na adres: Nowa Piasecznica 8/8, 96-516 Szymanów.
2.4.3. w formie elektronicznej za pośrednictwem poczty elektronicznej na adres: contact@turowskikrzysztof.com;
2.4.4. Zaleca się podanie przez Usługobiorcę w opisie reklamacji: (1) informacji i okoliczności dotyczących przedmiotu reklamacji, w szczególności rodzaju i daty wystąpienia nieprawidłowości; (2) żądania Usługobiorcy; oraz (3) danych kontaktowych składającego reklamację – ułatwi to i przyspieszy rozpatrzenie reklamacji przez Usługodawcę. Wymogi podane w zdaniu poprzednim mają formę jedynie zalecenia i nie wpływają na skuteczność reklamacji złożonych z pominięciem zalecanego opisu reklamacji.
2.4.5. Ustosunkowanie się do reklamacji przez Usługodawcę następuje niezwłocznie, nie później niż w terminie 14 dni kalendarzowych od dnia jej złożenia.

3. WARUNKI ZAWIERANIA UMOWY SPRZEDAŻY
3.1. Zawarcie Umowy Sprzedaży między Klientem, a Sprzedawcą następuje po uprzednim złożeniu przez Klienta Zamówienia za pomocą Formularza Zamówień w Sklepie Internetowym zgodnie z pkt. 2.1.2 Regulaminu.
3.2. Cena Produktu uwidoczniona na stronie Sklepu Internetowego podana jest w złotych polskich i zawiera podatki. O łącznej cenie wraz z podatkami Produktu będącego przedmiotem Zamówienia, a także o kosztach dostawy (w tym opłatach za transport, dostarczenie i usługi pocztowe) oraz o innych kosztach, a gdy nie można ustalić wysokości tych opłat – o obowiązku ich uiszczenia, Klient jest informowany na stronach Sklepu Internetowego w trakcie składania Zamówienia, w tym także w chwili wyrażenia przez Klienta woli związania się Umową Sprzedaży.
3.3. Procedura zawarcia Umowy Sprzedaży w Sklepie Internetowym za pomocą Formularza Zamówień
3.3.1. Zawarcie Umowy Sprzedaży między Klientem, a Sprzedawcą następuje po uprzednim złożeniu przez Klienta Zamówienia w Sklepie Internetowym zgodnie z pkt. 2.1.2 Regulaminu.
3.3.2. Po złożeniu Zamówienia Sprzedawca niezwłocznie potwierdza jego otrzymanie oraz jednocześnie przyjmuje Zamówienie do realizacji. Potwierdzenie otrzymania Zamówienia i jego przyjęcie do realizacji następuje poprzez przesłanie przez Sprzedawcę Klientowi stosownej wiadomości e-mail na podany w trakcie składania Zamówienia adres poczty elektronicznej Klienta, która zawiera co najmniej oświadczenia Sprzedawcy o otrzymaniu Zamówienia i o jego przyjęciu do realizacji oraz potwierdzenie zawarcia Umowy Sprzedaży. Z chwilą otrzymania przez Klienta powyższej wiadomości e-mail zostaje zawarta Umowa Sprzedaży między Klientem, a Sprzedawcą.
3.4. Utrwalenie, zabezpieczenie oraz udostępnienie Klientowi treści zawieranej Umowy Sprzedaży następuje poprzez (1) udostępnienie niniejszego Regulaminu na stronie Sklepu Internetowego oraz (2) przesłanie Klientowi wiadomości e-mail, o której mowa w pkt. 3.3.2. Regulaminu. Treść Umowy Sprzedaży jest dodatkowo utrwalona i zabezpieczona w systemie informatycznym Sklepu Internetowego Sprzedawcy.

4. SPOSOBY I TERMINY PŁATNOŚCI ZA PRODUKT
4.1. Sprzedawca udostępnia Klientowi następujące sposoby płatności z tytułu Umowy Sprzedaży:
4.1.1. Płatność za pobraniem przy odbiorze przesyłki.
4.1.2. Płatność gotówką przy odbiorze osobistym.
4.1.3. Płatność przelewem na rachunek bankowy Sprzedawcy.
4.1.3.1. Bank: BZ WBZ SA
4.1.3.2. Numer rachunku: 90 1090 1870 0000 0001 3457 6197
4.1.4. Płatności elektroniczne i płatności kartą płatniczą za pośrednictwem serwisu PayPal – możliwe aktualne sposoby płatności określone są na stronie internetowej www.paypal.pl.
4.2. Rozliczenia transakcji płatnościami elektronicznymi i kartą płatniczą przeprowadzane są zgodnie z wyborem Klienta za pośrednictwem serwisu PayPal.
4.3. Termin płatności:
4.3.1. W przypadku wyboru przez Klienta płatności przelewem, płatności elektronicznych albo płatności kartą płatniczą, Klient obowiązany jest do dokonania płatności w terminie 7 dni kalendarzowych od dnia zawarcia Umowy Sprzedaży.
4.3.2. W przypadku wyboru przez Klienta płatności za pobraniem przy odbiorze przesyłki Klient obowiązany jest do dokonania płatności przy odbiorze przesyłki.

5. KOSZT, SPOSOBY I TERMIN DOSTAWY ORAZ ODBIORU PRODUKTU
5.1. Dostawa Produktu dostępna jest na terytorium wszystkich krajów.
5.2. Dostawa Produktu do Klienta jest odpłatna, chyba że Umowa Sprzedaży stanowi inaczej. Koszty dostawy Produktu (w tym opłaty za transport, dostarczenie i usługi pocztowe) są wskazywane Klientowi na stronach Sklepu Internetowego w zakładce -Koszty dostawy- oraz w trakcie składania Zamówienia, w tym także w chwili wyrażenia przez Klienta woli związania się Umową Sprzedaży.
5.3. Odbiór osobisty Produktu przez Klienta jest bezpłatny.
5.4. Sprzedawca udostępnia Klientowi następujące sposoby dostawy lub odbioru Produktu:
5.4.1. Przesyłka pocztowa 48, Przesyłka Pocztowa Paczka +, Przesyłka pocztowa
5.4.2. Przesyłka pocztowa międzynarodowa
5.4.3. Odbiór osobisty dostępny pod adresem: Nowa Piasecznica 8/8, 96-516 Szymanów – w Dni Robocze, po poprzednim potwierdzeniu terminu odbioru.
5.5. Termin dostawy Produktu do Klienta wynosi 25 Dni Roboczych, chyba że w opisie danego Produktu lub w trakcie składania Zamówienia podano krótszy termin. W przypadku Produktów o różnych terminach dostawy, terminem dostawy jest najdłuższy podany termin, który jednak nie może przekroczyć 25 Dni Roboczych. Początek biegu terminu dostawy Produktu do Klienta liczy się w następujący sposób:
5.5.1. W przypadku wyboru przez Klienta sposobu płatności przelewem, płatności elektroniczne lub kartą płatniczą – od dnia uznania rachunku bankowego lub konta rozliczeniowego Sprzedawcy.
5.5.2. W przypadku wyboru przez Klienta sposobu płatności za pobraniem – od dnia zawarcia Umowy Sprzedaży.
5.6. Termin gotowości Produktu do odbioru przez Klienta – w przypadku wyboru przez Klienta odbioru osobistego Produktu, Produkt będzie gotowy do odbioru przez Klienta w terminie do 25 Dni Roboczych, chyba że w opisie danego Produktu lub w trakcie składania Zamówienia podano krótszy termin. W przypadku Produktów o różnych terminach gotowości do odbioru, terminem gotowości do odbioru jest najdłuższy podany termin, który jednak nie może przekroczyć 25 Dni Roboczych. O gotowości Produktu do odbioru Klient zostanie dodatkowo poinformowany przez Sprzedawcę poprzez przesłanie stosownej wiadomości e-mail na podany w trakcie składania Zamówienia adres poczty elektronicznej Klienta. Początek biegu terminu gotowości Produktu do odbioru przez Klienta liczy się w następujący sposób:
5.6.1. W przypadku wyboru przez Klienta sposobu płatności przelewem, płatności elektroniczne lub kartą płatniczą – od dnia uznania rachunku bankowego lub konta rozliczeniowego Sprzedawcy.
5.6.2. W przypadku wyboru przez Klienta sposobu gotówką przy odbiorze osobistym – od dnia zawarcia Umowy Sprzedaży.

6. REKLAMACJA PRODUKTU
(DOTYCZY UMÓW SPRZEDAŻY ZAWARTYCH OD 25 GRUDNIA 2014 ROKU)
6.1. Podstawa i zakres odpowiedzialności Sprzedawcy względem Klienta, jeżeli sprzedany Produkt ma wadę fizyczną lub prawną (rękojmia) są określone powszechnie obowiązującymi przepisami prawa, w szczególności w Kodeksie Cywilnym.
6.2. Sprzedawca obowiązany jest dostarczyć Klientowi Produkt bez wad. Szczegółowe informacje dotyczące odpowiedzialności Sprzedawcy z tytułu wady Produktu oraz uprawnień Klienta są określone na stronie Sklepu Internetowego w zakładce -Reklamacja towaru-.
6.3. Reklamacja może zostać złożona przez Klienta na przykład:
6.3.1. pisemnie na adres: Nowa Piasecznica 8/8, 96-516 Szymanów.
6.3.2. w formie elektronicznej za pośrednictwem poczty elektronicznej na adres: Ten adres pocztowy jest chroniony przed spamowaniem. Aby go zobaczyć, konieczne jest włączenie w przeglądarce obsługi JavaScript – contact@turowskikrzysztof.com.
6.4. Zaleca się podanie przez Klienta w opisie reklamacji: (1) informacji i okoliczności dotyczących przedmiotu reklamacji, w szczególności rodzaju i daty wystąpienia wady; (2) żądania sposobu doprowadzenia Produktu do zgodności z Umową Sprzedaży lub oświadczenia o obniżeniu ceny albo odstąpieniu od Umowy Sprzedaży; oraz (3) danych kontaktowych składającego reklamację – ułatwi to i przyspieszy rozpatrzenie reklamacji przez Sprzedawcę. Wymogi podane w zdaniu poprzednim mają formę jedynie zalecenia i nie wpływają na skuteczność reklamacji złożonych z pominięciem zalecanego opisu reklamacji.
6.5. Sprzedawca ustosunkuje się do reklamacji Klienta niezwłocznie, nie później niż w terminie 14 dni kalendarzowych od dnia jej złożenia. Brak ustosunkowania się Sprzedawcy w powyższym terminie oznacza, że Sprzedawca uznał reklamację za uzasadnioną.
6.6. W przypadku, gdy do ustosunkowania się przez Sprzedawcę do reklamacji Klienta lub do wykonania uprawnień Klienta wynikających z rękojmi niezbędne będzie dostarczenie Produktu do Sprzedawcy, Klient zostanie poproszony przez Sprzedawcę o dostarczenie Produktu na koszt Sprzedawcy na adres Nowa Piasecznica 8/8, 96-516 Szymanów. Jeżeli jednak ze względu na rodzaj wady, rodzaj Produktu lub sposób jego zamontowania dostarczenie Produktu przez Klienta byłoby niemożliwe albo nadmiernie utrudnione, Klient poproszony zostanie o udostępnienie, po uprzednim uzgodnieniu terminu, Produktu Sprzedawcy w miejscu, w którym Produkt się znajduje.
6.7. Prośba o dostarczenie Produktu, o której mowa w pkt. 7.6 Regulaminu nie ma wpływu na bieg terminu na ustosunkowanie się Sprzedawcy do reklamacji Klienta, o którym mowa w pkt. 7.5 Regulaminu oraz nie narusza prawa Klienta żądania od Sprzedawcy demontażu wadliwego Produktu i ponownego zamontowania Produktu po dokonaniu wymiany na wolny od wad lub usunięciu wady, o którym mowa w art. 561[1] Kodeksu cywilnego.

7. POZASĄDOWE SPOSOBY ROZPATRYWANIA REKLAMACJI I DOCHODZENIA ROSZCZEŃ ORAZ ZASADY DOSTĘPU DO TYCH PROCEDUR
7.1. Szczegółowe informacje dotyczące możliwości skorzystania przez Klienta będącego konsumentem z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń oraz zasady dostępu do tych procedur dostępne są w siedzibach oraz na stronach internetowych powiatowych (miejskich) rzeczników konsumentów, organizacji społecznych, do których zadań statutowych należy ochrona konsumentów, Wojewódzkich Inspektoratów Inspekcji Handlowej oraz pod następującymi adresami internetowymi Urzędu Ochrony Konkurencji i Konsumentów:http://www.uokik.gov.pl/spory_konsumenckie.php;http://www.uokik.gov.pl/sprawy_indywidualne.php orazhttp://www.uokik.gov.pl/wazne_adresy.php.
7.2. Klient będący konsumentem posiada następujące przykładowe możliwości skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń:
7.2.1. Klient uprawniony jest do zwrócenia się do stałego polubownego sądu konsumenckiego, o którym mowa w art. 37 ustawy z dnia 15 grudnia 2000 r. o Inspekcji Handlowej (Dz.U. 2001 nr 4 poz. 25 ze zm.), z wnioskiem o rozstrzygnięcie sporu wynikłego z zawartej Umowy Sprzedaży. Regulamin organizacji i działania stałych polubownych sądów konsumenckich określa rozporządzenie ministra sprawiedliwości z dnia 25 września 2001 r. w sprawie określenia regulaminu organizacji i działania stałych polubownych sądów konsumenckich. 7.2.2. Klient uprawniony jest do zwrócenia się do wojewódzkiego inspektora Inspekcji Handlowej, zgodnie z art. 36 ustawy z dnia 15 grudnia 2000 r. o Inspekcji Handlowej (Dz.U. 2001 nr 4 poz. 25 ze zm.), z wnioskiem o wszczęcie postępowania mediacyjnego w sprawie polubownego zakończenia sporu między Klientem, a Sprzedawcą. Informacja na temat zasad i trybu procedury mediacji prowadzonej przez wojewódzkiego inspektora Inspekcji Handlowej dostępna jest w siedzibach oraz na stronach internetowych poszczególnych Wojewódzkich Inspektoratów Inspekcji Handlowej.
7.2.3. Klient może uzyskać bezpłatną pomoc w sprawie rozstrzygnięcia sporu między Klientem, a Sprzedawcą, korzystając także z bezpłatnej pomocy powiatowego (miejskiego) rzecznika konsumentów lub organizacji społecznej, do której zadań statutowych należy ochrona konsumentów (m.in. Federacja Konsumentów, Stowarzyszenie Konsumentów Polskich). 8. PRAWO ODSTĄPIENIA OD UMOWY
(DOTYCZY UMÓW SPRZEDAŻY ZAWARTYCH OD 25 GRUDNIA 2014 ROKU)
8.1. Konsument, który zawarł umowę na odległość, może w terminie 14 dni kalendarzowych odstąpić od niej bez podawania przyczyny i bez ponoszenia kosztów, z wyjątkiem kosztów określonych w pkt. 10.8 Regulaminu. Do zachowania terminu wystarczy wysłanie oświadczenia przed jego upływem. Oświadczenie o odstąpieniu od umowy może zostać złożone na przykład:
8.1.1. pisemnie na adres: Nowa Piasecznica 8/8, 96-516 Szymanów.
8.1.2. w formie elektronicznej za pośrednictwem poczty elektronicznej na adres: contact@turowskikrzysztof.com;
8.2. Przykładowy wzór formularza odstąpienia od umowy zawarty jest w załączniku nr 2 do Ustawy o Prawach Konsumenta oraz dodatkowo dostępny jest na stronie Sklepu Internetowego w zakładce -Odstąpienie od umowy-. Konsument może skorzystać z wzoru formularza, jednak nie jest to obowiązkowe.
8.3. Bieg terminu do odstąpienia od umowy rozpoczyna się:
8.3.1. dla umowy, w wykonaniu której Sprzedawca wydaje Produkt, będąc zobowiązany do przeniesienia jego własności (np. Umowa Sprzedaży) – od objęcia Produktu w posiadanie przez konsumenta lub wskazaną przez niego osobę trzecią inną niż przewoźnik, a w przypadku umowy, która: (1) obejmuje wiele Produktów, które są dostarczane osobno, partiami lub w częściach – od objęcia w posiadanie ostatniego Produktu, partii lub części albo (2) polega na regularnym dostarczaniu Produktów przez czas oznaczony – od objęcia w posiadanie pierwszego z Produktów;
8.3.2. dla pozostałych umów – od dnia zawarcia umowy.
8.4. W przypadku odstąpienia od umowy zawartej na odległość umowę uważa się za niezawartą.
8.5. Sprzedawca ma obowiązek niezwłocznie, nie później niż w terminie 14 dni kalendarzowych od dnia otrzymania oświadczenia konsumenta o odstąpieniu od umowy, zwrócić konsumentowi wszystkie dokonane przez niego płatności, w tym koszty dostawy Produktu (z wyjątkiem dodatkowych kosztów wynikających z wybranego przez Klienta sposobu dostawy innego niż najtańszy zwykły sposób dostawy dostępny w Sklepie Internetowym). Sprzedawca dokonuje zwrotu płatności przy użyciu takiego samego sposobu płatności, jakiego użył konsument, chyba że konsument wyraźnie zgodził się na inny sposób zwrotu, który nie wiąże się dla niego z żadnymi kosztami. Jeżeli Sprzedawca nie zaproponował, że sam odbierze Produkt od konsumenta, może wstrzymać się ze zwrotem płatności otrzymanych od konsumenta do chwili otrzymania Produktu z powrotem lub dostarczenia przez konsumenta dowodu jego odesłania, w zależności od tego, które zdarzenie nastąpi wcześniej.
8.6. Konsument ma obowiązek niezwłocznie, nie później niż w terminie 14 dni kalendarzowych od dnia, w którym odstąpił od umowy, zwrócić Produkt Sprzedawcy lub przekazać go osobie upoważnionej przez Sprzedawcę do odbioru, chyba że Sprzedawca zaproponował, że sam odbierze Produkt. Do zachowania terminu wystarczy odesłanie Produktu przed jego upływem. Konsument może zwrócić Produkt na adres: Nowa Piasecznica 8/8, 96-516 Szymanów.
8.7. Konsument ponosi odpowiedzialność za zmniejszenie wartości Produktu będące wynikiem korzystania z niego w sposób wykraczający poza konieczny do stwierdzenia charakteru, cech i funkcjonowania Produktu.
8.8. Możliwe koszty związane z odstąpieniem przez konsumenta od umowy, które obowiązany jest ponieść konsument:
8.8.1. Jeżeli konsument wybrał sposób dostawy Produktu inny niż najtańszy zwykły sposób dostawy dostępny w Sklepie Internetowym, Sprzedawca nie jest zobowiązany do zwrotu konsumentowi poniesionych przez niego dodatkowych kosztów.
8.8.2. Konsument ponosi bezpośrednie koszty zwrotu Produktu.
8.8.3. W przypadku Produktu będącego usługą, której wykonywanie – na wyraźne żądanie konsumenta – rozpoczęło się przed upływem terminu do odstąpienia od umowy, konsument, który wykonuje prawo odstąpienia od umowy po zgłoszeniu takiego żądania, ma obowiązek zapłaty za świadczenia spełnione do chwili odstąpienia od umowy. Kwotę zapłaty oblicza się proporcjonalnie do zakresu spełnionego świadczenia, z uwzględnieniem uzgodnionej w umowie ceny lub wynagrodzenia. Jeżeli cena lub wynagrodzenie są nadmierne, podstawą obliczenia tej kwoty jest wartość rynkowa spełnionego świadczenia.
8.9. Prawo odstąpienia od umowy zawartej na odległość nie przysługuje konsumentowi w odniesieniu do umów:
8.9.1. (1) o świadczenie usług, jeżeli Sprzedawca wykonał w pełni usługę za wyraźną zgodą konsumenta, który został poinformowany przed rozpoczęciem świadczenia, że po spełnieniu świadczenia przez Sprzedawcę utraci prawo odstąpienia od umowy; (2) w której cena lub wynagrodzenie zależy od wahań na rynku finansowym, nad którymi Sprzedawca nie sprawuje kontroli, i które mogą wystąpić przed upływem terminu do odstąpienia od umowy; (3) w której przedmiotem świadczenia jest Produkt nieprefabrykowany, wyprodukowany według specyfikacji konsumenta lub służący zaspokojeniu jego zindywidualizowanych potrzeb; (4) w której przedmiotem świadczenia jest Produkt ulegający szybkiemu zepsuciu lub mająca krótki termin przydatności do użycia; (5) w której przedmiotem świadczenia jest Produkt dostarczany w zapieczętowanym opakowaniu, którego po otwarciu opakowania nie można zwrócić ze względu na ochronę zdrowia lub ze względów higienicznych, jeżeli opakowanie zostało otwarte po dostarczeniu; (6) w której przedmiotem świadczenia są Produkty, które po dostarczeniu, ze względu na swój charakter, zostają nierozłącznie połączone z innymi rzeczami; (7) w której przedmiotem świadczenia są napoje alkoholowe, których cena została uzgodniona przy zawarciu Umowy Sprzedaży, a których dostarczenie może nastąpić dopiero po upływie 30 dni i których wartość zależy od wahań na rynku, nad którymi Sprzedawca nie ma kontroli; (8) w której konsument wyraźnie żądał, aby Sprzedawca do niego przyjechał w celu dokonania pilnej naprawy lub konserwacji; jeżeli Sprzedawca świadczy dodatkowo inne usługi niż te, których wykonania konsument żądał, lub dostarcza Produkty inne niż części zamienne niezbędne do wykonania naprawy lub konserwacji, prawo odstąpienia od umowy przysługuje konsumentowi w odniesieniu do dodatkowych usług lub Produktów; (9) w której przedmiotem świadczenia są nagrania dźwiękowe lub wizualne albo programy komputerowe dostarczane w zapieczętowanym opakowaniu, jeżeli opakowanie zostało otwarte po dostarczeniu; (10) o dostarczanie dzienników, periodyków lub czasopism, z wyjątkiem umowy o prenumeratę; (11) zawartej w drodze aukcji publicznej; (12) o świadczenie usług w zakresie zakwaterowania, innych niż do celów mieszkalnych, przewozu rzeczy, najmu samochodów, gastronomii, usług związanych z wypoczynkiem, wydarzeniami rozrywkowymi, sportowymi lub kulturalnymi, jeżeli w umowie oznaczono dzień lub okres świadczenia usługi; (13) o dostarczanie treści cyfrowych, które nie są zapisane na nośniku materialnym, jeżeli spełnianie świadczenia rozpoczęło się za wyraźną zgodą konsumenta przed upływem terminu do odstąpienia od umowy i po poinformowaniu go przez Sprzedawcę o utracie prawa odstąpienia od umowy.
8.9.2. Zwrotowi nie podlega Towar nieprefabrykowany, wyprodukowany według specyfikacji Kupującego lub służący zaspokojeniu jego zindywidualizowanych potrzeb.

9. POSTANOWIENIA DOTYCZĄCE PRZEDSIĘBIORCÓW
9.1. Niniejszy punkt Regulaminu oraz postanowienia w nim zawarte dotyczą wyłącznie Klientów i Usługobiorców nie będących konsumentami.
9.2. Sprzedawcy przysługuje prawo odstąpienia od Umowy Sprzedaży zawartej z Klientem niebędącym konsumentem w terminie 14 dni kalendarzowych od dnia jej zawarcia. Odstąpienie od Umowy Sprzedaży w tym wypadku może nastąpić bez podania przyczyny i nie rodzi po stronie Klienta niebędącego konsumentem żadnych roszczeń w stosunku do Sprzedawcy.
9.3. W wypadku Klientów nie będących konsumentami Sprzedawca ma prawo ograniczyć dostępne sposoby płatności, w tym także wymagać dokonania przedpłaty w całości albo części i to niezależnie od wybranego przez Klienta sposobu płatności oraz faktu zawarcia Umowy Sprzedaży.
9.4. Z chwilą wydania przez Sprzedawcę Produktu przewoźnikowi przechodzą na Klienta nie będącego konsumentem korzyści i ciężary związane z Produktem oraz niebezpieczeństwo przypadkowej utraty lub uszkodzenia Produktu. Sprzedawca w takim wypadku nie ponosi odpowiedzialności za utratę, ubytek lub uszkodzenie Produktu powstałe od przyjęcia go do przewozu aż do wydania go Klientowi oraz za opóźnienie w przewozie przesyłki.
9.5. W razie przesłania Produktu do Klienta za pośrednictwem przewoźnika Klient nie będący konsumentem obowiązany jest zbadać przesyłkę w czasie i w sposób przyjęty przy przesyłkach tego rodzaju. Jeżeli stwierdzi, że w czasie przewozu nastąpił ubytek lub uszkodzenie Produktu, obowiązany jest dokonać wszelkich czynności niezbędnych do ustalenia odpowiedzialności przewoźnika.
9.6. Zgodnie z art. 558 § 1 Kodeksu Cywilnego odpowiedzialność Sprzedawcy z tytułu rękojmi za Produkt wobec Klienta nie będącego konsumentem zostaje wyłączona.
9.7. W wypadku Usługobiorców nie będących konsumentami Usługodawca może wypowiedzieć umowę o świadczenie Usługi Elektronicznej ze skutkiem natychmiastowym i bez wskazywania przyczyn poprzez przesłanie Usługobiorcy stosownego oświadczenia.
9.8. Odpowiedzialność Usługodawcy/Sprzedawcy w stosunku do Usługobiorcy/Klienta nie będącego konsumentem, bez względu na jej podstawę prawną, jest ograniczona – zarówno w ramach pojedynczego roszczenia, jak również za wszelkie roszczenia w sumie – do wysokości zapłaconej ceny oraz kosztów dostawy z tytułu Umowy Sprzedaży, nie więcej jednak niż do kwoty jednego tysiąca złotych. Usługodawca/Sprzedawca ponosi odpowiedzialność w stosunku do Usługobiorcy/Klienta nie będącego konsumentem tylko za typowe szkody przewidywalne w momencie zawarcia umowy i nie ponosi odpowiedzialności z tytułu utraconych korzyści w stosunku do Usługobiorcy/Klienta nie będącego konsumentem.
9.9. Wszelkie spory powstałe pomiędzy Sprzedawcą/Usługodawcą, a Klientem/Usługobiorcą niebędącym konsumentem zostają poddane sądowi właściwemu ze względu na siedzibę Sprzedawcy/Usługodawcy.

10. DANE OSOBOWE W SKLEPIE INTERNETOWYM
10.1. Administratorem danych osobowych Usługobiorców/Klientów zbieranych za pośrednictwem Sklepu Internetowego jest Sprzedawca.
10.2. Dane osobowe Usługobiorców/Klientów zbierane przez administratora za pośrednictwem Sklepu Internetowego zbierane są – zgodnie z wolą Usługobiorcy/Klienta – w celu realizacji Umowy Sprzedaży lub umowy o świadczenie Usługi Elektronicznej.
10.3. Możliwi odbiorcy danych osobowych Klientów Sklepu Internetowego:
10.3.1. W przypadku Klienta, który korzysta w Sklepie Internetowym ze sposobu dostawy przesyłką pocztową lub przesyłką kurierską, Administrator udostępnia zebrane dane osobowe Klienta wybranemu przewoźnikowi lub pośrednikowi realizującemu przesyłki na zlecenie Administratora.
10.3.2. W przypadku Klienta, który korzysta w Sklepie Internetowym ze sposobu płatności elektronicznych lub kartą płatniczą Administrator udostępnia zebrane dane osobowe Klienta, wybranemu podmiotowi obsługującemu powyższe płatności w Sklepie Internetowym.
10.4. Usługobiorca/Klient ma prawo dostępu do treści swoich danych oraz ich poprawiania. Żądanie w tym zakresie może zostać złożone na przykład:
10.4.1. pisemnie na adres: Nowa Piasecznica 8/8, 96-516 Szymanów;
10.4.2. w formie elektronicznej za pośrednictwem poczty elektronicznej na adres: contact@turowskikrzysztof.com;
10.5. Podanie danych osobowych jest dobrowolne, aczkolwiek niepodanie wskazanych w Regulaminie danych osobowych niezbędnych do zawarcia Umowy Sprzedaży lub umowy o świadczenie Usługi Elektronicznej skutkuje brakiem możliwości zawarcia tejże umowy. Dane niezbędne do zawarcia Umowy Sprzedaży lub umowy o świadczenie Usługi Elektronicznej wskazane są także każdorazowo na stronie internetowej Sklepu Internetowego przed zawarciem danej umowy.

11. POSTANOWIENIA KOŃCOWE
11.1. Umowy zawierane poprzez Sklep Internetowy zawierane są w języku polskim lub angielskim
11.2. Zmiana Regulaminu:
11.2.1. Usługodawca zastrzega sobie prawo do dokonywania zmian Regulaminu z ważnych przyczyn to jest: zmiany przepisów prawa; zmiany sposobów płatności i dostaw – w zakresie, w jakim te zmiany wpływają na realizację postanowień niniejszego Regulaminu.
11.2.2. W przypadku zawarcia na podstawie niniejszego Regulaminu umów o charakterze ciągłym (np. świadczenie Usługi Elektronicznej – Konto) zmieniony regulamin wiąże Usługobiorcę, jeżeli zostały zachowane wymagania określone w art. 384 oraz 384[1] Kodeksu cywilnego, to jest Usługobiorca został prawidłowo powiadomiony o zmianach i nie wypowiedział umowy w terminie 14 dni kalendarzowych od dnia powiadomienia. W wypadku gdyby zmiana Regulaminu skutkowała wprowadzeniem jakichkolwiek nowych opłat lub podwyższeniem obecnych Usługobiorca będący konsumentem ma prawo odstąpienia od umowy.
11.2.3. W przypadku zawarcia na podstawie niniejszego Regulaminu umów o innym charakterze niż umowy ciągłe (np. Umowa Sprzedaży) zmiany Regulaminu nie będą w żaden sposób naruszać praw nabytych Usługobiorców/Klientów będących konsumentami przed dniem wejścia w życie zmian Regulaminu, w szczególności zmiany Regulaminu nie będą miały wpływu na już składane lub złożone Zamówienia oraz zawarte, realizowane lub wykonane Umowy Sprzedaży.
11.3. W sprawach nieuregulowanych w niniejszym Regulaminie mają zastosowanie powszechnie obowiązujące przepisy prawa polskiego, w szczególności: Kodeksu cywilnego; ustawy o świadczeniu usług drogą elektroniczną z dnia 18 lipca 2002 r. (Dz.U. 2002 nr 144, poz. 1204 ze zm.); dla Umów Sprzedaży zawartych od 25 grudnia 2014 roku z Klientami będącymi konsumentami – przepisy ustawy o prawach konsumenta z dnia 30 maja 2014 r. (Dz.U. 2014 r. poz. 827 ze zm.); oraz inne właściwe przepisy powszechnie obowiązującego prawa.

11. FINAL PROVISIONS
11.1. Agreements concluded via the Online Store are concluded in Polish or English
11.2. Amendments to the Regulations:
11.2.1. The Service Provider reserves the right to make changes to the Regulations for important reasons, that is: changes in the law; changes in payment and delivery methods – to the extent to which these changes affect the implementation of the provisions of these Regulations.
11.2.2. In case of concluding on the basis of these Regulations continuous contracts (eg providing Electronic Service – Account), the amended regulations bind the Customer if the requirements specified in art. 384 and 384 [1] of the Civil Code, that is, the Service Recipient was correctly informed about the changes and did not terminate the contract within 14 calendar days from the date of notification. CLIENT – (1) a natural person with full legal capacity, and in cases provided for by generally applicable regulations also a natural person with limited legal capacity; (2) legal person; or (3) an organizational unit without legal personality, which the law grants to legal capacity; – who has concluded or intends to conclude a Sale Agreement with the Seller.
1.4.5. CIVIL CODE – Civil Code of April 23, 1964 (Journal of Laws 1964 No. 16, item 93, as amended).
1.4.6. ACCOUNT – Electronic Service, marked with an individual name (login) and password provided by the Service Recipient, a set of resources in the Service Provider’s IT system in which data collected by the Service Recipient and information about Orders placed in the Online Store are collected.
1.4.7. NEWSLETTER – Electronic Service, electronic distribution service provided by the Service Provider via e-mail, which allows all recipients of the Service to automatically receive from the Service the cyclical content of subsequent editions of the newsletter containing information about Products, news and promotions in the Online Store.
1.4.8. PRODUCT – a movable item available in the Online Store which is the subject of a Sales Agreement between the Customer and the Seller.
1.4.9. REGULATIONS – these regulations of the Online Store.
1.4.10. ONLINE STORE – the Service Provider’s online store is available at www.turowskikrzysztof.com on the WordPress platform.
1.5. DEALER; SERVICE PROVIDER – Krzysztof Turowski running a business under the name of Krzysztof Turowski, entered into the Central Register and Information on Economic Activity of the Republic of Poland conducted by the minister responsible for economy, having: the address of the place of activity Nowa Piasecznica 8/8, 96-516 Szymanów, Poland, NIP 4970010366 , e-mail address: contact@turowskikrzysztof.com
1.5.1. SALES AGREEMENT – a Product sales contract concluded or concluded between the Customer and the Seller via the Online Store.
1.5.2. ELECTRONIC SERVICE service provided electronically by the Service Provider to the Customer via the Online Store.
1.5.3. SERVICE USER – (1) a natural person with full legal capacity, and in cases provided for by generally applicable regulations also a natural person with limited legal capacity; (2) legal person; or (3) an organizational unit without legal personality, which the law grants to legal capacity; – using or intending to use the Electronic Service.
1.5.4. CONSUMER RIGHTS ACT, ACT – the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended).
1.5.5. ORDER – Customer’s declaration of intent submitted via the Order Form and aiming directly at the conclusion of the Product Sales Agreement with the Seller.

2. ELECTRONIC SERVICES IN THE ONLINE STORE
2.1. The following Electronic Services are available in the Online Store: Account, Order Form and Newsletter.
2.1.1. Account – using the Account is possible after completing three consecutive steps by the Customer – (1) completing the Registration Form, (2) clicking the „Create Account” field and (3) confirming the willingness to create an Account by clicking the confirmation link sent automatically to the given e-mail address. In the Registration Form it is necessary for the Customer to provide the following data of the Service Recipient: name and surname / company name, address (street, house / flat number, zip code, city, country), e-mail address, contact telephone number and password. In the case of Customers who are not consumers, it is also necessary to provide the company name and tax identification number.
2.1.1.1. The Electronic Account service is provided free of charge for an indefinite period. The Service Recipient has the option, at any time and without giving any reason, to delete the Account (resignation from the Account) by sending an appropriate request to the Service Provider, in particular via e-mail to the following address: contact@turowskikrzysztof.com or in writing to: Nowa Piasecznica 8 / 8, 96-516 Szymanów, Poland
2.1.2. The Order Form use of the Order Form begins with the Customer adding the first Product to the electronic basket in the Online Store. Placement of the Order takes place after the Customer completes two consecutive steps (1) after completing the Order Form and (2) clicking on the Online Store website after completing the Order Form. Order with the obligation to pay – up to this moment it is possible to modify the entered data independently (including order should be guided by displayed messages and information available on the Online Store website). In the Order Form, it is necessary for the Customer to provide the following data about the Customer: name and surname / company name, address (street, house / flat number, zip code, city, country), e-mail address, contact telephone number and data regarding the Sale Agreement: Product (s), amount of Product (s), place and method of delivery of the Product (s), method of payment. In the case of customers who are not consumers, it is also necessary to provide the company name and tax identification number.
2.1.2.1. The Electronic Order Form Service is provided free of charge and is of a one-off nature and terminates when the Order is placed via it or when the Ordering Party ceases to place the Order through it.
2.1.3. Newsletter – the use of the Newsletter follows the publication in the tab -Newsletter – the e-mail address visible on the Online Store website, to which further editions of the Newsletter are to be sent and click on the field – 'Scribe’. You can subscribe to the Newsletter by checking the appropriate checkbox when creating an Account – once the Account is created, the Customer is subscribed to the Newsletter.
2.1.3.1. The Electronic Newsletter service is provided free of charge for an indefinite period. The Customer may, at any time and without giving any reason, unsubscribe from the Newsletter (resignation from the Newsletter) by sending a relevant request to the Service Provider, in particular via e-mail to the following address: contact@turowskikrzysztof.com or in writing to the following address: Nowa Piasecznica 8/8, 96-516 Szymanów, Poland
2.2. Technical requirements necessary to cooperate with the ICT system used by the Service Provider: (1) a computer, laptop or other multimedia device with Internet access; (2) access to electronic mail; (3) Internet browser: Mozilla Firefox version 11.0 and above or Internet Explorer version 7.0 and higher, Opera version 7.0 and higher, Google Chrome version 12.0.0 and higher; (4) recommended minimum screen resolution: 1024×768; (5) enabling cookies and Javascript support in the web browser.
2.3. The Service Recipient is obliged to use the Online Store in a manner consistent with the law and morality with respect for the personal rights and copyrights and intellectual property of the Service Provider and third parties. The Service Recipient is obliged to enter data consistent with the actual state. The recipient is prohibited from providing unlawful content.
2.4. Procedure of complaint proceedings:
2.4.1. Complaints related to the provision of Electronic Services by the Service Provider and other complaints related to the operation of the Online Store (excluding the Product complaint procedure, which is indicated in points 6 and 7 of the Regulations), the Client may submit, for example:
2.4.2. in writing to the following address: Nowa Piasecznica 8/8, 96-516 Szymanów, Poland.
2.4.3. in felectronic mail via e-mail to the following address: contact@turowskikrzysztof.com; 2.4.4. It is recommended that the Customer provide the following in the description of the complaint: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of occurrence of the irregularity; (2) the Customer’s request; and (3) contact details of the complainant – this will facilitate and speed up the consideration of the complaint by the Service Provider. The requirements specified in the preceding sentence take the form of recommendations only and do not affect the effectiveness of complaints submitted omitting the recommended description of the complaint.2.4.5. The response to the complaint by the Service Provider takes place immediately, not later than within 14 calendar days from the date of its submission.

3. CONDITIONS FOR CONCLUDING A SALES AGREEMENT
3.1. Conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed the Order using the Order Form in the Online Store in accordance with point. 2.1.2 of the Regulations.
3.2. The Product price shown on the Online Store website is given in Polish zlotys and includes taxes. The total price including taxes of the Product being the subject of the Order, as well as delivery costs (including transport, delivery and postal charges) and other costs, and if it is impossible to determine the amount of these fees – about the obligation to pay, the Customer is informed on the Online Store pages when placing an Order, including when the Customer wishes to be bound by the Sales Agreement.
3.3. The procedure of concluding a Sales Agreement in the Online Store using the Order Form
3.3.1. Conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order in the Online Store in accordance with point. 2.1.2 of the Regulations.
3.3.2. After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for implementation shall take place by sending by the Seller an e-mail address provided at the time of placing the Order e-mail address, which contains at least the Seller’s statement of receipt of the Order and its acceptance for implementation and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above e-mail by the Customer, a Sales Agreement is concluded between the Customer and the Seller.
3.4. Consolidation, security and making available to the Customer the content of the Sales Agreement concluded by (1) providing these Regulations on the Online Store website and (2) sending the e-mail message referred to in point. 3.3.2. Regulations. The content of the Sales Agreement is additionally recorded and secured in the IT system of the Seller’s Online Store.

4. METHODS AND TERMS OF PAYMENT FOR THE PRODUCT
4.1. The Seller provides the Customer with the following methods of payment under the Sales Agreement:
4.1.1. Payment on delivery on delivery.
4.1.2. Payment in cash on a personal collection.
4.1.3. Payment by bank transfer to the Seller’s bank account.
4.1.3.1. Bank: BZ WBZ SA

4.1.4. Electronic payments and card payments via PayPal – current payment methods are available at www.paypal.pl.
4.2. Settlement of transactions by electronic payments and payment cards are carried out in accordance with the Customer’s choice via PayPal.
4.3. Date of payment:
4.3.1. If the Customer chooses payment by bank transfer, electronic payment or payment by credit card, the Customer is obliged to make payment within 7 calendar days from the date of the Sale Agreement.
4.3.2. If the Customer selects payment for downloading on delivery, the Customer is obliged to make the payment upon delivery.

5. COST, METHODS AND DELIVERY TIME AND RECEIPT OF THE PRODUCT
5.1. Product delivery is available on the territory of all countries.
5.2. The delivery of the Product to the Customer is payable, unless the Sales Agreement provides otherwise. The delivery costs of the Product (including charges for transport, delivery and postal services) are indicated to the Customer on the Online Store website in the tab – Delivery Costs – and during the Order placement, including when the Customer wishes to be bound by the Sales Agreement.
5.3. The Customer’s personal collection of the Product is free.
5.4. The Seller provides the Customer with the following methods of delivery or collection of the Product:
5.4.1. Postal shipment 48, Postal Shipment Parcel +, Postal shipment
5.4.2. International postal order
5.4.3. Personal collection available at: Nowa Piasecznica 8/8, 96-516 Szymanów, Poland – on Working Days, after the previous confirmation of the date of receipt.
5.5. The deadline for delivery of the Product to the Customer is 25 Business Days, unless a shorter period is specified in the description of the Product or when placing the Order. In the case of Products with different delivery times, the delivery date is the longest given date, which, however, can not exceed 25 Business Days. The beginning of the delivery of the Product to the Customer counts as follows:
5.5.1. If the Customer chooses the method of payment by bank transfer, electronic payment or payment card – from the date of crediting the Seller’s bank account or settlement account.
5.5.2. If the Customer chooses the method of payment on delivery – from the day of concluding the Sale Agreement.
5.6. The deadline for the Product to be picked up by the Customer – if the Customer selects a personal Product collection, the Product will be ready to be picked up by the Customer within 25 Business Days, unless a shorter deadline is given in the description of the Product or when placing the Order. In the case of Products with different dates of readiness for collection, the deadline for receipt is the longest given date, which, however, can not exceed 25 Business Days. The Customer will be additionally informed about the readiness of the Product by the Seller by sending an appropriate e-mail to the Customer’s e-mail address provided during the Ordering. The start of the Product’s ready-to-pick up period counts as follows:
5.6.1. If the Customer chooses the method of payment by bank transfer, electronic payment or payment card – from the date of crediting the Seller’s bank account or settlement account.
5.6.2. If the Customer chooses cash in personal collection – from the date of the Sale Agreement.

6. COMPLAINT OF THE PRODUCT
(APPLIES TO SALES AGREEMENTS CONCLUDED FROM 25 DECEMBER 2014)
6.1. The basis and scope of the Seller’s liability towards the Customer, if the product sold has a physical or legal defect (warranty) is defined by generally applicable laws, in particular in the Civil Code.
6.2. The Seller is obliged to provide the Customer with a Product without defects. Detailed information on the Seller’s liability due to a Product defect and Customer’s rights are set out on the Online Store’s website in the tab – Commodity declaration -.
6.3. The complaint may be submitted by the Customer, for example:
6.3.1. in writing to the following address: Nowa Piasecznica 8/8, 96-516 Szymanów, Poland.
6.3.2. in electronic form via email to the following address: This email address is protected from spamming. To view it, you must enable JavaScript in your browser – contact@turowskikrzysztof.com.
6.4. It is recommended that the Customer provide in the description of the complaint: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of the defect; (2) request a way to bring the Product into compliance with the Sales Agreement or a statement of price reduction or withdrawal from the Sales Agreement; and (3) contact details of the complaining party – this will facilitate and accelerate the complaint handling by the Seller. The requirements set out in the preceding sentence are only recommendations and do not affect the effectiveness of complaints filed without the recommended description of the complaint.
6.5. The Seller shall respond to the Customer’s complaint promptly, no later than within 14 calendar days from the date of its submission. Lack of the Seller’s attitude in the above-mentioned period means that the Seller has considered the complaint justified.
6.6. In case when the Seller responds to the Customer’s complaint or to exercise the Customer’s rights resulting from the warranty, it will be necessary to deliver the Product to the Seller, the Customer will be asked by the Seller to deliver the Product at the Seller’s expense to the following address: Nowa Piasecznica 8/8, 96-516 Szymanów, Poland . If, however, due to the type of the defect, the type of the Product or the method of its installation, delivery of the Product by the Customer would be impossible or excessively difficult, the Customer will be asked to provide, after prior agreement, the Product of the Seller in the place where the Product is located.
6.7. A request to provide the Product referred to in point 7.6 of the Regulations does not affect the course of the period for the Seller’s response to the Client’s complaint referred to in point. 7.5 of the Regulations and does not violate the Customer’s right to demand from the Seller the disassembly of the defective Product and re-installation of the Product after exchange for a fault-free or defective item referred to in Art. 561 [1] of the Civil Code.

7. EXTRAJUDICIAL METHODS OF SETTLING COMPLAINTS AND INVESTIGATING CLAIMS AND RULES OF ACCESS TO THESE PROCEDURES
7.1. Detailed information on the possibility of the client using the extrajudicial method of dealing with complaints and redress and the rules of access to these procedures are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations, whose statutory tasks include consumer protection, Voivodship Inspectorates of the Trade Inspection and the following Internet addresses of the Office of Competition and Consumer Protection: http: //www.uokik.gov.pl/spory_konsumenckie.php; http: //www.uokik.gov.pl/sprawy_indywidualne.php andhttp: // www .uokik.gov.pl / wazne_adresy.php.
7.2. The customer who is a consumer has the following exemplary possibilities to use non-judicial means of dealing with complaints and redress:
7.2.1. The customer is entitled to apply to a permanent amicable consumer court, referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2001 No. 4 item 25, as amended), with a request to settle the dispute arising from the concluded Sales Agreement. The regulations of the organization and operation of permanent consumer courts of arbitration are specified in the regulation of the Minister of Justice of September 25, 2001 on defining the rules of organization and operation of permanent consumer courts of arbitration. (OJ 2001, No. 113, item 1214).
7.2.2. The customer is entitled to apply to the provincial inspector of Trade Inspection, pursuant to art. 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws 2001 No. 4 item 25, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Customer and the Seller. Information on the rules and mode of the mediation procedure conducted by the provincial inspector of the Trade Inspection is available at the headquarters and on the websites of individual Provincial Inspectorates of the Trade Inspection.
7.2.3. The customer may get free assistance in resolving the dispute between the Customer and the Seller, also using the free help of the poviat (municipal) consumer ombudsman or social organization, whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers). Advice is provided by the Consumer Federation under the free consumer helpline number 800 007 707 and by the Polish Consumer Association at the email address. 8. RIGHT TO WITHDRAW FROM THE AGREEMENT
(APPLIES TO SALES AGREEMENTS CONCLUDED FROM 25 DECEMBER 2014)
8.1. A consumer who has concluded a distance contract may, within 14 calendar days, withdraw from it without giving any reason and without incurring costs, except for the costs specified in point. 10.8 of the Regulations. To comply with the deadline, it is enough to send a statement before its expiry. The declaration on withdrawal from the contract may be made, for example:
8.1.1. in writing to the following address: Nowa Piasecznica 8/8, 96-516 Szymanów, Poland.
8.1.2. in electronic form via e-mail to the following address: contact@turowskikrzysztof.com;
8.2. An exemplary model of withdrawal from the contract is included in Annex 2 to the Consumer Rights Act and is additionally available on the Online Store’s website in the tab – Agreement withdrawal. The consumer can use the form template, but it is not mandatory.
8.3. The period for withdrawing from the contract begins to run:
8.3.1. for a contract whereby the Seller issues a Product, being obliged to transfer its ownership (eg a Sales Agreement) – from taking the Product into possession by the consumer or a third party designated by him, other than the carrier, and in the case of a contract which: (1) many Products that are delivered separately, in batches or in parts – from taking possession of the last Product, batch or part, or (2) consists in regular delivery of Products for a specified period – from taking possession of the first Product;
8.3.2. for other contracts – from the date of conclusion of the contract.
8.4. In the event of withdrawal from a distance contract, the contract is considered void.
8.5. The Seller is obliged to immediately, no later than within 14 calendar days from the date of receipt of the consumer’s statement on withdrawal from the contract, return all payments made to him, including the delivery of the Product (except for additional costs resulting from the delivery method chosen by the Customer other than the cheapest standard delivery method available in the Online Store). The seller shall refund the payment using the same method of payment as the consumer used, unless the consumer has expressly agreed to a different method of return, which does not entail any costs for him. If the Seller has not offered to collect the Product from the consumer himself, he may withhold the reimbursement of payments received from the consumer until receipt of the Product or delivery by the consumer of proof of his return, depending on which event occurs first.
8.6. The consumer is obliged to immediately, no later than within 14 calendar days from the day on which he withdrawn from the contract, return the Product to the Seller or hand it over to the person authorized by the Seller for pickup, unless the Seller suggested that he will pick up the Product himself. To meet the deadline, it is enough to return the Product before its expiry. The consumer may return the Product to the following address: Nowa Piasecznica 8/8, 96-516 Szymanów, Poland.
8.7. The consumer is liable for the decrease in the value of the Product as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product.
8.8. Possible costs related to the consumer’s withdrawal from the contract that the consumer is obliged to incur:
8.8.1. If the consumer has chosen the method of delivery of the Product other than the cheapest standard delivery method available in the Online Store, the Seller is not obliged to refund the additional costs incurred by the Seller.
8.8.2. The consumer bears direct costs of returning the Product.
8.8.3. In the case of a Product being a service whose performance – at the express request of the consumer – started before the deadline to withdraw from the contract, the consumer who exercises the right to withdraw from the contract after making such a request is obliged to pay for the services fulfilled until the withdrawal from the contract. The payment amount is calculated in proportion to the scope of the service provided, taking into account the price or remuneration agreed in the contract. If the price or remuneration is excessive, the basis for calculating this amount is the market value of the fulfilled benefit.
8.9. The right to withdraw from a distance contract is not available to the consumer in relation to contracts:
8.9.1. (1) for the provision of services, if the Seller has fully provided the service with the express consent of the consumer who has been informed before the provision that he will lose the right to withdraw from the contract after the performance of the service by the Seller; (2) in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the deadline for withdrawal from the contract; (3) in which the object of the service is a non-prefabricated Product, manufactured according to the consumer’s specification or serving to satisfy his individual needs; (4) in which the subject of the service is a product that is subject to rapid deterioration or has a short shelf-life; (5) in which the object of the service is a product delivered in a sealed package, which after opening the packaging can not be returned due to health protection or hygiene reasons, if the packaging was opened after delivery; (6) in which the subject of the service are Products which after delivery, due to their nature, are inseparably connected with other items; (7) in which the subject of the service are alcoholic beverages, the price of which was agreed at the conclusion of the Sale Agreement, and which delivery may take place only after 30 days and whose value depends on the fluctuations on the market over which the Seller has no control; (8) in which the consumer explicitly demanded that the Seller should come to him for urgent repair or maintenance; if the Seller provides additional services other than those required by the Consumer, or provides Products other than spare parts necessary to perform the repair or maintenance, the right to withdraw from the contract is granted to the consumer in relation to additional services or Products; (9) in which the object of the service are sound or visual recordings or computer software delivered in a sealed package, if the packaging has been opened after delivery; (10) for the delivery of newspapers, periodicals or magazines, with the exception of a subscription agreement; (11) concluded through a public auction; (12) for the provision of accommodation services, other than for residential purposes, the carriage of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract indicates the day or period of service provision; (13) for delivery of digital content that is not recorded on a tangible medium if the performance commenced with the consumer’s express consent before the deadline to withdraw from the contract and after informing the Seller about the loss of the right to withdraw from the contract.8.9.2. Non-prefabricated goods manufactured according to the Buyer’s specification or serving to satisfy his individual needs are not subject to return.

9. PROVISIONS CONCERNING ENTREPRENEURS
9.1. This section of the Regulations and the provisions contained herein apply only to Clients and Service Users who are not consumers.
9.2. The Seller has the right to withdraw from the Sales Agreement concluded with the Customer who is not a consumer within 14 calendar days from the date of its conclusion. Withdrawal from the Sales Agreement in this case may take place without giving a reason and does not give rise to any claims on the part of the Customer who is not a consumer in relation to the Seller.
9.3. In the case of customers who are not consumers, the Seller has the right to limit the available payment methods, including requiring prepayment in whole or in part, regardless of the payment method chosen by the Customer and the fact of concluding the Sales Agreement.
9.4. Upon the release of the Product by the Seller, the carrier shall pass to the Customer who is not a consumer the benefits and burdens associated with the Product and the risk of accidental loss or damage to the Product. In such a case, the Seller shall not be liable for any loss, loss or damage to the Product arising from its acceptance for transport until it is delivered to the Customer and for delay in transporting the shipment.
9.5. In the event of sending the Product to the Customer via a carrier, the Customer who is not a consumer is obliged to inspect the parcel in time and in the manner accepted for such shipments. If he determines that during the transport there was a loss or damage to the Product, he is obliged to perform all actions necessary to determine the liability of the carrier.
9.6. According to art. 558 § 1 of the Civil Code, the Seller’s liability under the warranty for the Product towards the Customer who is not a consumer is excluded.
9.7. In the case of Customers who are not consumers, the Service Provider may terminate the contract for the provision of Electronic Services with immediate effect and without indicating reasons by sending a relevant statement to the Service Recipient.
9.8. Liability of the Service Provider / Seller in relation to the Service Recipient / Customer who is not a consumer, regardless of its legal basis, is limited – both as part of a single claim, as well as for all claims in total – up to the price paid and delivery costs under the Sales Agreement, however, not more than up to one thousand zlotys. The Service Provider / Seller is liable towards the Service Recipient / Customer who is not a consumer only for typical damage predictable at the time the contract is concluded and is not liable for lost profits in relation to the Service Recipient / Customer who is not a consumer.
9.9. Any disputes arising between the Seller / Service Provider and the Client / Service User who is not a consumer shall be subject to the court having jurisdiction over the seat of the Seller / Service Provider.

10. PERSONAL DATA IN AN ONLINE STORE
10.1. The administrator of the personal data of the Customers / Clients collected via the Online Store is the Seller.
10.2. The personal data of the Customers / Clients collected by the administrator via the Online Store are collected – in accordance with the will of the Customer / Client – for the purpose of implementing the Sales Agreement or contract for the provision of Electronic Services.
10.3. Possible recipients of personal data of Customers of the Online Store:
10.3.1. In the case of a Customer who uses the Online Store with the method of delivery by post or courier, the Administrator provides the Customer’s personal data collected to a selected carrier or intermediary performing the shipment at the request of the Administrator.
10.3.2. In the case of a Customer who uses the Online Store with the method of electronic payments or with a payment card, the Administrator provides the collected personal data of the Customer to the selected entity servicing the above payments in the Online Store.
10.4. The Service Recipient / Customer has the right to access their data and correct them. The request in this respect can be made, for example:

10.5. Providing personal data is voluntary, but failure to provide the personal data specified in the Regulations necessary to conclude a Sales Agreement or a contract for the provision of Electronic Services results in the inability to conclude this contract. The data necessary to conclude a Sales Agreement or an agreement for the provision of Electronic Services are also indicated on the website of the Online Store each time before concluding a given contract.

 

11. FINAL PROVISIONS
11.1. Agreements concluded via the Online Store are concluded in Polish or English
11.2. Amendments to the Regulations:
11.2.1. The Service Provider reserves the right to make changes to the Regulations for important reasons, that is: changes in the law; changes in payment and delivery methods – to the extent to which these changes affect the implementation of the provisions of these Regulations.
11.2.2. In case of concluding on the basis of these Regulations continuous contracts (eg providing Electronic Service – Account), the amended regulations bind the Customer if the requirements specified in art. 384 and 384 [1] of the Civil Code, that is, the Service Recipient was correctly informed about the changes and did not terminate the contract within 14 calendar days from the date of notification. In the event that a change in the Regulations would result in the introduction of any new fees or increase in the existing Customers who is a consumer has the right to withdraw from the contract.
11.2.3. In the case of concluding agreements of a different nature from continuous contracts (eg a Sales Agreement), amendments to the Regulations will not in any way affect the acquired rights of Customers / Customers who are consumers before the effective date of amendments to the Regulations, in particular amendments to the Regulations will not impact on already placed or placed Orders and concluded, implemented or executed Sales Agreements.
11.3. In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on Electronic Services of July 18, 2002 (Journal of Laws of 2002 No. 144, item 1204, as amended); for Sale Agreements concluded from December 25, 2014 with customers who are consumers – the provisions of the Act on Consumer Rights of 30 May 2014 (Journal of Laws of 2014, item 827, as amended); and other relevant provisions of generally applicable law.
